The Santa Experience or without Santa Session Terms & Conditions

1. The Santa Experience Sessions are pre-paid. Each session is up to 15 minutes long with Santa, Fee is based upon a photographic session for up to four individuals or a combo with pets in the studio. If more than 4 children/pets or extended family members wish to be involved, back-to-back sessions must be booked, to accommodate all those wishing to be photographed. Having a back-to-back session will give you an extended time to interact with Santa. Or even booking back-to-back sessions, can give you a 1/2 hr visit with Santa. Back-to-back sessions $298- 8 files, or $498-for all files.

Sessions will be hosted by Playtography and held in Lake Chaparral at Playtography's home studio.

Sessions will be held in November and December.

COVID-19
The health and well-being of Santa, photographers, and the families who visit are our highest priority. As we want everyone to enjoy Christmas this year!

We are doing the following:
*Santa, Lisa, and Christina are fully vaccinated. We know children under 12 are exempt, and we do need to follow the government restrictions with parents who may not be vaccinated.

* We have limited our sessions, to 2 families, within 1 hour instead of 3. This allows us time to properly sanitize all high touch services, change out any props that may need to be washed, and give time to help with traffic flow.

* Please arrive on time to allow for noncrowded entries. If you, have more than 4 people to be photographed in your family, you MUST book back-to-back sessions, to allow for us, to not have too many people. This allows also you to have more time with Santa and allows us the time to properly clean. Only immediate family members can attend. Extended family and friends will have to book their own sessions.

*Hand Sanitizer will be provided and must be used or use your own, upon arrival and departure.

*Masks must be worn by all participants, upon entry into our home studio. All will be wearing masks, as it is a part of our set. Masks can be temporarily removed, as long as social distancing is maintained during the photo session.

*No children will sit on Santa's lap.

    *All props/toys that will be used will be cleaned, changed, or washed prior to the next visitor.

PLEASE STAY HOME: If you have any of the Covid-19 symptoms (running nose, red eyes, cough, fever), have traveled outside of the country, or have been in contact with anyone that is waiting for a Covid-19 result. We can arrange a different alternative such as a personal zoom visit with Santa, instead.

I , referred to in this Agreement as “Client”agrees that Christina Parker, referred to in this Agreement as “Photographer”, shall provide portrait photography services in the manner described in this Agreement. The Agreement incorporates the entire understanding between Client and Photographer and supersedes all prior agreements between the parties. This Agreement may be altered or modified in a written instrument signed by both parties. Client must provide Photographer with a signed copy of this Agreement and pay the non-refundable booking fee before Photographer is required to provide any services.

Two photographers, will be on site. You may either have Christina with Playtography, or Lisa with SavvyCat Photography

The fees are based on per family, not per child.

Client will pay Photographer total fees of either $149.00 or up to $249 if you like, Santa can give your child a gift, $30 per child, or bring your own, per session booked, subject to Client paying Photographer a non-refundable booking fee of 149.00 to secure the date with Photographer prior to or at the time of signing this Agreement. Unless otherwise noted in this Agreement, this booking fee is non-refundable in the event of cancellation for any reason or rescheduling by Client. No date is reserved until Photographer receives a signed copy of this Agreement and the booking fee. Unless this Agreement is cancelled, the booking fee shall be applied to the total fee for the services provided. The balance of all fees due must be received by the Photographer on or before the date of the session.

Your appointment might be asked to be moved to have Santa be more efficient in his time, as he's a busy fellow this time of the year, and more times will be added, when our current times are filled.

Sessions take place at 68 Chapman Terrace SE, please park either around the island, in the driveway, or down by the mailboxes, when you first enter the street. Walk through the black flower gate, and down to the walk out doors.

2. Cancellations/Rescheduling. If Client cancels within 24 hrs of the session, the payment is non-refundable, due to the lack of time to refill the spot as Santa does have a fee. Your session, can be gifted to someone else you know, or it can also go towards credits towards a future session with Playtography/SavvyCat Photography. We can arrange a different alternative such as a personal zoom visit with Santa, instead.
If Playtography or Savvy Cat Photography cancels , either the other photographer can fill in, or we will refund you total cost of your session, less the Santa fees. As much as we do want to honour your time slot; it may be subjective to be moved to keep our sessions, effiently flowing.

3. Client understands that the Santa Experience is up to 10 minute story telling session, with 5 mins on the other set. The photography schedule and selected methodology are designed to accomplish the goals and wishes of the client in a manner enjoyed by all parties. Client, and Playtography /Savvy Cat Photography agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the schedule start time. Lateness will cause your session to be shorten, the session can be carried further into another time slot if available, but a surcharge of $100 will be charged to help pay for Santa's/photographers time.

4. Images: Depending on what package you choose, an approx 4-10+ images will be processed within a 2 week time frame. Client will choose from either an online gallery or online zoom gallery. To ensure the best print quality, avoid altering the images before printing, and ask that the lab of your choice does not colour correct. The photographer is not responsible for printing errors, the quality of prints, or products printed elsewhere. No files larger than 8x12 will be sold with a print release. Any files, larger are to be printed through Playtography and Savvy Cat Photography.

5. Behavior: Please note, I will have another set, that will be up at the opposite end of my studio, at the same time. Please, keep an eye on all your children, to not be near the other set. There will be an activity table, where the children can play at, if wished, and where items will be cleaned after each use.

6. Electronic Device: Cameras, cell phones, and video recorders are not permitted during sessions.

7. Modifications: If the client has a request for a small alteration of an image, such as lens glare, please let the photographer know before your image is downloaded. Minor changes such as tigher crop, or fix minor skin blemishes, can be fixed complimentary. More involved requests, such as lens glare, will be billed at $40/hr, and Christina Parker will discuss the cost of these changes before work will be done. Once the requested changes are made, charges will apply.

8. Social Media. The Client may share blog post links and Facebook photos through the use of the share functions and dissemination of direct links. Client shall not copy, download, screen shot, or capture the photographs in any other fashion.

9. Limitation of Liablity: In the unlikely event of a total photographic failure because of a technical issue, cancellation of this Agreement by either party or in any other circumstances, the liability of Photographer shall be limited to the total value of any payment by Client to Photographer and Photographer shall not be liable for any indirect or consequential damages.

If Photographer is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, extreme weather, labour disputes, electrical failure, or technical problems (such as camera, computer, hard drive or memory card malfunction), and if Photographer cannot provide Client with the option of using another competent professional photographer, all payments received by Photographer, minus reasonable expenses, will be returned to Client, and Photographer shall have no further liability with respect to this Agreement. The limitation of liability also applies to any loss/damage of photographs or failure to deliver Photographs for any reason. Liability for a partial loss of photographs shall be prorated based on the percentage of total Photographs taken.

10. All images are copyright under the Federal law of Canada, under the Canadian Copyright Act. By signing the box, you are agreeing to this contract, to not copy, save or reproduce images in any way. This includes copying and saving images from the website, on line gallery, blog, Facebook, or any other form of advertisement.

Playtography and Savvy Cat Photography retains the copyright on all images, and reserves the right to use the images for advertising, display, publications, or other purposes. Playtography and SavvyCat Photography will honor Client's rights. If Client does not want their photographs, or their minor displayed via social media, or for advertising purposes, Playtography and Savvy Cat Photography will respect this right.

11 Indemnification: Client shall indemnify and hold Photographer harmless from and against all losses, claims, actions, costs and expenses (including reasonable legal fees) resulting from Client’s breach of any of the terms of this Agreement .

12. The parties of this Agreement are independent contractors and agree that no joint venture,  partnership or employer-employee relationship exists between the parties. This Agreement may be executed in counterparts. If any provision of this Agreement is held to be invalid or unenforceable  under law, the validity of the Agreement as a whole shall not be affected, and the other provisions of
the Agreement shall remain in full force and effect.

I hereby give permission to Playtography and Savvy Cat Photography and her legal representatives and assigns, those for whom the photographer is acting, and those with her permission or her employee, the right, and permission to copyright and/or use, reuse, and/or publish, and republish photographic portraits of me, or reproductions thereof in colour, or black and white made through any media by the photography at her studio or elsewhere. I hereby warrant that I am over the legal age of consent in the province, territory, state of country in which the photographic images were taken, and competent to contract in my own name insofar as the above is concerned. I have read the foregoing release, authorization and agreement, before affixing my signature below and warrant that I fully understand and agreement, before affixing my signature below, and warrant that I fully understand the contents thereof.
